Terms of Service

The terms governing your use of NoTimeRx's telemedicine platform, services, and products within the United States.

Plain-English summary. NoTimeRx is a U.S.-only telehealth platform. It connects patients with independent U.S.-licensed medical providers and ships FDA-approved medications from licensed U.S. pharmacies. It is not a substitute for emergency care.

1. Acceptance of these Terms

By accessing or using www.notimerx.com, the NoTimeRx mobile app, or any other NoTimeRx service (collectively, the "Services"), you agree to be bound by these Terms of Service, our Privacy Policy, and our HIPAA Notice of Privacy Practices. If you do not agree, do not use the Services.

2. Eligibility and U.S.-only Services

The Services are offered solely to individuals who are (a) at least 18 years old, (b) physically located in the United States (including D.C. and U.S. territories where we are licensed), and (c) able to form a legally binding contract. We do not ship internationally, and medical services are only available while the patient is physically located in a U.S. state or territory where our provider network is licensed.

If you attempt to use the Services from outside the United States, you must stop immediately. We may geofence access, decline orders, or cancel accounts that we believe are outside our licensed service area.

3. NoTimeRx is a Platform — Not a Medical Practice

NoTimeRx, Inc. ("NoTimeRx," "we") is a technology company. We do not practice medicine. Medical care is provided by independently-owned professional medical entities and their employed or contracted U.S.-licensed physicians and nurse practitioners (collectively, "Providers"). Medications are dispensed by independently-owned, U.S.-licensed pharmacies. NoTimeRx facilitates the connection and logistics; the provider–patient and pharmacist–patient relationships are with those independent practices and pharmacies.

4. Telehealth Consent

By starting a visit, you consent to receive care by telehealth, which involves:

  • Exchange of medical history, photos, and secure messages with a Provider;
  • Asynchronous ("store-and-forward") review when clinically appropriate;
  • Issuance of a prescription if — and only if — the Provider determines treatment is appropriate;
  • Transmission of your Protected Health Information over encrypted channels.

Telehealth has limits. Physical exams cannot be performed remotely. In an emergency, call 911 or go to the nearest emergency room — do not use the Services.

5. Your Account

You are responsible for keeping your login credentials confidential, for all activity under your account, and for providing accurate and current information to your Provider. You agree not to share your account with anyone else.

6. Prescriptions, Compounding & Fulfillment

Providers exercise independent clinical judgment. A visit does not guarantee a prescription. If prescribed, we ship FDA-approved generics and/or compounded formulas from licensed U.S. pharmacies to your verified U.S. shipping address. You agree to follow your Provider's instructions and to report adverse events through the portal or directly to your Provider.

Certain products in our Clinic Specialties & Frontier Compounded Biologics catalog (including but not limited to Verteporfin and PLGA depot formulations such as PLGA-Dutasteride mesotherapy and PLGA-IGF-1) are available only to credentialed U.S. clinics and licensed physicians and are not sold or shipped to consumers.

7. Subscriptions, Refills & Billing

Most plans are recurring monthly subscriptions. By enrolling, you authorize NoTimeRx's billing partner to charge your payment method on the schedule shown at checkout until you cancel. You may cancel at any time from your patient dashboard; cancellation stops future charges and shipments but does not refund charges already processed for medications already shipped.

All prices are in U.S. dollars. Your payment method may be billed by a pharmacy partner rather than NoTimeRx.

8. Physician and Clinic Partner Users

If you access the Physician Portal or Clinic Partner Portal, additional terms apply, including your Provider Services Agreement or Clinic Partner Agreement. Clinic Partner accounts may only place orders for biologics or controlled compounded products while in good standing, with verified credentials, and within scope of state and federal law.

9. Acceptable Use

You agree not to:

  • Provide false information or misrepresent your identity, location, or medical history;
  • Resell, divert, or export any medication obtained through the Services;
  • Attempt to gain unauthorized access to the Services or another user's account;
  • Use the Services to harass any Provider or staff member, or to violate any law.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." NOTIMERX DISCLAIMS ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTIMERX DOES NOT WARRANT ANY SPECIFIC MEDICAL OUTCOME.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTIMERX AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF (a) AMOUNTS PAID BY YOU TO NOTIMERX IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) $100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY APPLICABLE LAW, INCLUDING LIABILITY ARISING FROM THE INDEPENDENT PROFESSIONAL JUDGMENT OF PROVIDERS.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association in New Castle County, Delaware. You waive the right to participate in class actions. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@notimerx.com.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced through the Services or by email. Continued use after the effective date constitutes acceptance.
